CONSUMER DISCLOSURE: Odds of winning are based upon the number of Twitter entries. Based upon Addison Avenue Federal Credit Union’s estimate of 2,000 entries, odds of winning are 1 in 500.
SPONSOR: Addison Avenue Federal Credit Union (“the Credit Union”) is the sponsor of the Sweepstakes. The Credit Union’s business address is: 3408 Hillview Avenue, Palo Alto, CA 94304.
SWEEPSTAKES PERIOD: Sweepstakes begins 9/14/09 at 12:01 am (PT) and ends 11/9/09 at 11:59 PM (PT).
ELIGIBILITY: Credit Union employees, officials and members of their immediate families are not eligible to participate in the Sweepstakes. To qualify for the Sweepstakes, all entrants must have a Twitter account and be at least 18 years of age. Winners will need to become a Credit Union member (and open a Membership Share Account). If the winner refuses to open a Membership Share account, the winner will be provided the prize in cash. By entering this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of the Credit Union. Sweepstakes void where prohibited by law.
HOW TO ENTER: Beginning on 9/14/09 at 12:01 AM (PT) through 11/9/09 at 11:59 PM (PT), all eligible persons may enter the Sweepstakes by sending a tweet from their Twitter accounts and include #bankintervention in their message. Entrants can tweet as often as they wish, as well as include any additional message they wish. Each tweet will be eligible for the prize drawing. Winner Selection: One winner will be selected every two weeks in a random drawing from among all eligible entries received during the Sweepstakes period. Drawings will be conducted by the Credit Union, whose decisions are final. Prizes and Approximate Retail Value: Four (4) prizes: Membership Share Savings account, value of $250 each. Winners will be tweeted by Addison Avenue from Addison Avenue’s Twitter account (@addisonavenue) after the close of business day. To find out if you’ve won, make sure to follow @addisonavenue. Winners will be announced after the close of that respective business day. Prizes will be deposited within 30 days of announcement into winning person’s Membership Share account. Prize winners will be notified via a “@ message” directed at their Twitter account. If the winner refuses to open a Membership Share account, the winner will be provided the prize in cash. If there is no response from the winner after one week of notification, the Credit Union will pick another winner.
ENTRIES: There is no limit of Twitter entries that can be made. Entries using macro, robotic, script or other forms of automatic entry will be disqualified. Once submitted, entries become the property of the Credit Union and will not be returned. All eligible entries received on or before 11:59 p.m. (PT) on 11/9/09 qualify for the prize drawings. Proof of submission does not constitute proof of receipt. The Credit Union is not responsible for late, incomplete, or inaccurate entries. If there is a dispute as to the identity of a Twitter entrant, a new winner will be chosen.
CONDITIONS OF PARTICIPATION: Entrants must have a valid Twitter account. Expenses not specifically included in prize description and all taxes are the sole responsibility of the winner. The Credit Union reserves the right to disqualify entrants who fail to follow these Official Rules and regulations or who make any misrepresentations relative to the Sweepstakes and redemption of a prize. Entrants agree to be bound by the terms of these Official Rules and by the decisions of the Credit Union, which are final and binding on all matters pertaining to this Sweepstakes. By accepting a prize, winner agrees to hold the Credit Union, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, assigns, officers, directors, and employees harmless for any injury or damage caused or claimed to be caused by participation in the promotion or acceptance, receipt, possession, use or misuse of the prize. The Credit Union is not responsible for any printing, typographical, mechanical or other error in the administration of the Sweepstakes or in the announcement of the prize.
INTERNET: The Credit Union is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by the Credit Union or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Credit Union reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. The Credit Union reserves the right to select winners from eligible entries received as of the termination date. The Credit Union further reserves the right to disqualify any individual who tampers with the entry process. The Credit Union may prohibit an entrant from participating in the Sweepstakes if it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair practices or intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Credit Union reserves the right to seek damages from any such participant to the fullest extent of the law.
PUBLICITY AUTHORIZATION: Each winner agrees to permit the Credit Union to utilize his/her name and likeness in promotional and other Credit Union materials, without additional compensation or permission, except where prohibited by law.
TAX ISSUES: The Credit Union will report all prize winnings to the appropriate state and federal agencies as required by applicable law. Winners are responsible for all tax consequences (if any) of the prizes.
NOTICE OF ARBITRATION AGREEMENT: These Official Rules provide that all disputes between you and the Credit Union will be resolved by BINDING ARBITRATION.
You thus GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (EXCEPT for matters that may be taken to SMALL CLAIMS COURT).
*Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury.
*You are entitled to a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT.
*Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and the Credit Union in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA, without regard to choice of law rules.
